Solicitors' Introduction & Referral Code 1990
As amended by the Solicitors' Introduction & Referral Code Amendment Provisions 1992
The Law Society, the solicitor's governing body, permits solicitors to make agreements with their introducing sources for referral work. Such agreements must comply with a code, known as the Solicitors Introduction and Referral Code, which contains strict rules to safeguard your interests as the customer. Clear Conveyancing and the panel solicitor have entered into a formal agreement under the Solicitors Introduction & Referral code. Clear Conveyancing is thus pleased to offer the conveyancing service direct to its customers at competitive rates
Notice to Clients of Clear Conveyancing
We comply with the Solicitors Introduction and Referral Code published by the Law Society, and any solicitor to whom we refer you is an independent professional, from whom you will receive impartial and confidential advice. You are free to choose another Solicitor.
Clear Conveyancing will provide the conveyancing service via one of the solicitors/licensed conveyancers on its panel. The Solicitor/Licensed Conveyancer will be notified to you when you confirm that you wish to proceed with the estimate of costs given.
All professional work will be undertaken directly for you and on your behalf by the panel firm of solicitors/conveyancers. The advice and service you get from the solicitor is, and will remain personal, confidential and independent and will be subject to your direct instructions at all times. You will be free to raise questions on all aspects of your matter. The Conveyancing Service provided will be Sale/Purchase/Re-Mortgage of freehold or leasehold domestic property as notified by you to Clear Conveyancing.
The charge payable by you for the conveyancing services is detailed on the estimate provided. Clear Conveyancing will pay its panel solicitor/licensed conveyancer for providing the conveyancing services to you upon receipt of payment by you of the conveyancing fees outlined in the estimate. The amount paid to the panel solicitor/licensed conveyancer will be notified to you in writing with our confirmation of acceptance of your estimate.
The charge for conveyancing services will not be affected whether or not you take other products or services offered by Clear Conveyancing from time to time. The availability and price of other products and services will not be affected whether you choose a Clear Conveyancing panel solicitor or decide to instruct another solicitor or conveyancer.
The Legal Costs and Disbursements of the transaction (as known to us at the date of the estimate) are set out in full on the estimate. Your solicitor/licensed conveyancer will ask you to pay for the searches in advance. The balance of the payment of Legal costs and disbursements must be paid by you in cleared funds prior to legal completion. Your solicitor/licensed conveyancer will send you a completion statement showing the balance required.
Should the matter not proceed to legal completion you will be obliged to pay for all searches and disbursements which the solicitor/licensed conveyancer has incurred on your behalf. If the matter proves abortive before exchange of contracts you will not be charged for the conveyancing services. Should the matter prove abortive/ or should you change solicitors after exchange of contracts then the solicitor/licensed conveyancer shall be entitled to be paid a fair proportion of the cost of the conveyancing services.
Clear Conveyancing charges you at the agreed rate set out on the estimate for the conveyancing service which the panel firm of solicitors provide for you. The panel firm of solicitors in turn charges Clear Conveyancing for supplying the service to you. The panel firm of solicitor's fee to Clear Conveyancing will be notified upon confirmation of referral and will be for a domestic purchase, sale or remortgage as notified by you. Thus Clear Conveyancing is remunerated out of the overall fee you pay, rather than by making a further separate charge.
Terms of use
The Clear Conveyancing website is designed to enable clients to access conveyancing services. All legal work if referred to the Clear Conveyancing panel of solicitors and licensed conveyancers (Clear Conveyancing undertake no legal work themselves). By using this website to obtain quotations and request legal services you are accepting the terms and conditions applying to the Clear Conveyancing website. If you do not agree to these terms and conditions you should not use the Clear Conveyancing website for legal or any other related services.
By accepting the estimate for conveyancing fees you authorise Clear Conveyancing to refer your transaction to an appointed panel solicitor/licensed conveyancer to undertake the work. You have been notified that you are free to instruct another solicitor of your choice and that there is no obligation for you to instruct the appointed solicitor. You confirm that you have not already appointed a solicitor to deal with the transaction nor do you wish to do so. The legal fees given on this website apply only to standard conveyancing transactions and do not apply to such legal work over and above the usual conveyancing services i.e. dealing with a defective title or lease etc. The additional cost of any such items will be notified to the client directly by the panel lawyer. If your transaction is cancelled for any reason you will still be responsible for any disbursements (such as searches) which have been paid out on your behalf by the panel lawyer. When you agree to proceed the panel lawyer will request a deposit which can be taken by credit or debit card. This will be deducted from the balance of monies owing by you upon legal completion of your transaction as notified by the panel solicitor. Should the transaction not proceed to completion the deposit will be automatically transferred to any subsequent transaction. Deposits are not transferable to transactions on behalf of third parties i.e. friends or relatives etc. Should there not be a subsequent transaction within twelve months of taking the initial deposit Clear Conveyancing can at their discretion refund the deposit less a fifty per cent deduction to cover administration fees. Unless you notify Clear Conveyancing or the appointed panel solicitor to the contrary you give permission for the panel lawyer to communicate all relevant information concerning your transaction to Clear Conveyancing who may include this is progress reports to relevant third parties. Your acceptance of any Clear Conveyancing conveyancing quotation confirms that you have read understood and accepted the above terms and conditions.
